Will my credit be ruined once I file for bankruptcy?

Most often, someone who is contemplating filing for bankruptcy has credit issues that have already affected their credit score. People with financial problems sometimes have late or missed payments to their creditors which in turn have been reported to the credit counseling agencies. While a bankruptcy filing may appear on your credit report for up to ten years, this does not stop you from getting credit. There are many different things that a creditor will look at before determining whether they will offer you credit. One of these factors is a person’s debt to income ratio. After receiving a discharge in a Chapter 7 case, your unsecured debt will be “wiped away”, thereby affecting this ratio along with leaving you a “fresh start”. A creditor will be able to see that you are not burdened with this excessive debt anymore, and will be inclined to lend you money. Another reason a creditor may be willing to lend you money is that they know you wont be able to file bankruptcy for another 8 years.

Therefore, after a bankruptcy filing, a person is often better situated to repay new creditors and in time can be a better credit risk than they were prior to the bankruptcy filing. A bankruptcy attorney can advise persons filing for bankruptcy protection as to the methods by which they can rebuild their credit rating.
